have all but ended academic libraries as useful things.

I do like openscience, and the work John Tennant is doing. You should
catch the wave of the future and look at it.

But otherwise, you are confusing an "ought" (or rather, a particular interpretation of "ought") for an "is".

Whether or not all online material SHOULD be put into creative commons or not is a matter of debate. What is not debatable is that **currently** not all such pieces are. And thus the authors of a manuscript must be careful about use of images they themselves did not create.

However, something that is not mentioned in Asher's initial post but which has come to light: a third party took Asher's image and put it on a different site (Dinopedia), where they labeled it as CC.

Thus, it is entirely possible that Otero et al. were acting in good faith and assumed the CC label was accurate, and the image was available for us.
