What would happen to birds under that definition - if we consider that birds could be representatives of a group (clade) perviously thought to have gone extinct long time ago.

How about: "a representative of a clade previously known only from fossils"? This would apply to _Latimeria_, _Dromiciops_, _Mantophasma_ and _Praedatophasma_*, and _Laonastes_.
* Just barely--the other known mantophasmatodean, the fossil taxon _Raptophasma_, was published one year before these extant taxa.
