Fraud is gaining profit by making false representations.

Hmm, sounds like fraudulent sales.
That is selling something one does not have the right to sell.

I think the charge is *failure* to report.
Certain types of investments and funds must be reported to
the fedral government for tax purposes.  Failure to do so
is a crime.
